Acceptance of Terms

By creating an account, accessing, or using Capacitly, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to use this Service. By using Capacitly, you represent and warrant that you meet this age requirement.

Account Registration

To use this Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Subscription and Payments

Subscription Plans

Capacitly offers subscription-based access to premium features. Subscription details, including pricing and features, are displayed at the time of purchase.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless you cancel at least 3 days before the renewal date.

Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. We do not provide prorated refunds for partial billing periods.

Third-Party Calendar Services

Capacitly integrates with third-party calendar services. By connecting these services:

• You authorize Capacitly to access, read, and sync your calendar data
• You acknowledge that your use of third-party services is subject to their respective terms of service and privacy policies
• You understand that Capacitly is not responsible for the availability, accuracy, or functionality of third-party calendar services

User Content and Conduct

Your Content

You retain ownership of all calendar data you create or upload to Capacitly ("User Content"). By using the Service, you grant us a limited license to process, store, and display your User Content solely to provide the Service.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Share calendar links containing harmful, abusive, or inappropriate content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or its servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or bots to access the Service
• Resell or redistribute the Service without authorization

Shared Calendar Links

When you create and share calendar links through Capacitly:

• You are responsible for determining what events are visible through each link
• You acknowledge that anyone with access to a shared link can view the events you have chosen to share
• You can revoke shared links at any time
• We are not responsible for how recipients use or further share the information visible through your shared links

Intellectual Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by Ploutos Studios LLC and is protected by copyright, trademark, and other intellectual property laws. Our trademarks, trade dress, and service marks may not be used without our prior written permission.

Disclaimer of Warranties

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLOUTOS STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Ploutos Studios LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete your account and User Content.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Wisconsin.
